Agreement and eligibility
These Terms are an agreement between you and the operator of Postlume, the service available at getpostlume.com. By creating an account or using the service, you agree to these Terms and acknowledge the Privacy Policy.
You must be at least 18, or the age of legal majority where you live, and able to form a binding agreement. If you use Postlume for an organization, you confirm that you have authority to bind it.
The service
Postlume provides tools for creating, adapting, organizing, and publishing visual content. Features may include identity kits, brand assets, AI image and text generation, layered editing, exports, credits, and optional connections to third-party platforms. Some features may be labelled alpha, beta, preview, or experimental and may change as we learn from use.
Accounts and access
- Provide accurate information and keep it reasonably current.
- Protect the Google account or email inbox used to access Postlume.
- Do not share access in a way that defeats account or plan limits.
- Tell us promptly at privacy@getpostlume.com if you believe your account has been compromised.
Your content and permissions
You retain your rights in content you upload and in outputs to the extent the law permits. You give Postlume a worldwide, non-exclusive, limited licence to host, copy, transform, transmit, and display that content only as needed to operate, secure, and improve the service and fulfil your requests. This licence ends when the content is deleted, except for limited backup, legal, or security needs.
You confirm that you have the rights, releases, and lawful basis needed for every image, logo, likeness, trademark, prompt, and other material you submit. If content shows another person, you are responsible for having their permission when the law requires it.
AI-generated content
- AI output can be inaccurate, unexpected, offensive, or similar to output produced for someone else.
- Review every result before publishing it. Postlume does not guarantee factual accuracy, legal clearance, platform acceptance, or commercial performance.
- You are responsible for checking rights, disclosures, and suitability for your intended use.
- Rights in AI output can vary by location and by the terms of the model provider used for a job. Postlume does not promise that an output is exclusive or eligible for intellectual-property protection.
Connected platforms and publishing
When you connect X, Instagram, or another platform, you authorize Postlume to use the permissions shown on that platform's consent screen for the settings you choose. You remain responsible for your accounts, content, audience, and compliance with the third party's rules.
Automation can be delayed, rejected, duplicated, reformatted, or made unavailable by provider limits and outages. Check important posts on the destination platform. Disconnecting stops future access but does not retract content already published.
Acceptable use
You must not use Postlume to:
- Break the law or another person's rights.
- Create or distribute fraud, impersonation, harassment, exploitation, non-consensual intimate imagery, or content that sexualizes minors.
- Upload a person's face, private information, or protected material without authority to process it.
- Bypass security or usage limits, scrape the service, introduce harmful code, probe another user's data, or interfere with operation.
- Resell account access, misrepresent AI content where disclosure is required, or use platform connections to spam or manipulate engagement.
Credits, plans, and payment
Postlume may use credits to measure paid operations. The applicable plan, price, included credits, renewal terms, and operation cost will be shown before purchase or use. Credits are service units, have no cash value, and cannot be transferred unless we expressly allow it.
An operation that consumed third-party resources is normally charged even if you dislike the result. When Postlume records an upstream failure, the service may automatically return the related credits. Any statutory cancellation or refund rights you have remain unaffected.
Postlume property and feedback
The service, software, interface, brand, and documentation belong to Postlume or its licensors. These Terms give you a limited, non-transferable right to use the service while your account is active. If you send feedback, you allow us to use it without restriction or payment, without identifying you publicly unless you agree.
Availability and changes
We may update, add, limit, or remove features and may suspend the service for maintenance, security, provider changes, or legal reasons. We will try to give reasonable notice when a material change affects a paid feature, but continuous or error-free availability is not guaranteed.
Suspension and termination
You can stop using Postlume at any time and request deletion using our data-deletion instructions. We may restrict or end access when reasonably necessary to protect users or the service, comply with law, address non-payment, or respond to a serious or repeated breach of these Terms.
Provisions that by their nature should survive termination do survive, including ownership, payment obligations, disclaimers, liability limits, and dispute terms.
Disclaimers
To the extent permitted by law, Postlume is provided on an “as is” and “as available” basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
Liability
Nothing in these Terms limits liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or any liability that cannot legally be limited.
For business users, to the extent permitted by law, Postlume is not liable for indirect, incidental, special, consequential, or lost-profit damages, and total liability arising from the service is limited to the amount you paid Postlume during the 12 months before the event giving rise to the claim. Consumer users retain remedies for losses that are a reasonably foreseeable result of our breach or failure to use reasonable care.
Applicable law, changes, and contact
Unless mandatory law provides otherwise, these Terms are governed by Portuguese law. If you are a consumer, this choice does not remove the mandatory protections or courts available where you live.
We may update these Terms as the service changes. The updated date will appear above, and we will give additional notice when required. Continuing to use the service after an effective update means the new Terms apply, subject to any rights the law gives you.
